1. High‑Risk Product Acknowledgment
Our products include motorcycle parts, performance components, and other items that are inherently dangerous. By purchasing from us, you explicitly acknowledge that:
  • Motorcycles and motorcycle parts can cause serious injury, property damage, or death.
  • You are solely responsible for determining whether a product is safe and appropriate for your specific motorcycle and intended use.
  • You understand that improper installation, modification, or use dramatically increases risk.
You agree that you—not Better Built Moto LLC—are fully responsible for any and all risks associated with these products.

2. Assumption of All Risks (No Exceptions)
By purchasing, installing, or using any product from Better Built Moto LLC, you voluntarily and knowingly assume every possible risk, including but not limited to:
  • Injury
  • Death
  • Mechanical failure
  • Loss of control
  • Property damage
  • Damage to other vehicles or persons
  • Legal consequences arising from your use of the product
You agree that these risks are your responsibility alone.

3. Release of Liability
To the fullest extent permitted by law, you hereby release, waive, and forever discharge Better Built Moto LLC, its owners, employees, contractors, suppliers, and affiliates from any and all liability, including but not limited to:
  • Personal injury
  • Death
  • Property damage
  • Economic loss
  • Claims from third parties
  • Any damages arising from installation, use, misuse, or failure of any product
This release applies even if the claim alleges negligence on the part of Better Built Moto LLC.

4. Limitation of Liability (Maximum Protection)
If a court ever finds that we are liable for anything (despite the above protections), you agree that:
  • Our total liability is strictly limited to the purchase price of the product in question.
  • We are not liable for any indirect, incidental, consequential, punitive, or special damages.
  • We are not responsible for legal fees, expert fees, court costs, or any other expenses you incur.
This limitation applies regardless of legal theory, including negligence, strict liability, warranty, or contract.

5. Indemnification (You Pay Our Legal Costs)
You agree to indemnify, defend, and hold harmless Better Built Moto LLC from any claims, lawsuits, damages, losses, or expenses—including attorney’s fees and court costs—arising from:
  • Your installation or use of our products
  • Your failure to follow instructions or safety guidelines
  • Your modification of any product
  • Any third‑party claims related to your motorcycle or riding activities
  • Your breach of these Terms & Conditions
If someone sues us because of something you did, you pay for it.

6. No Warranty — All Products Sold “As‑Is”
Unless explicitly stated otherwise in writing:
  • All products are sold as‑is with no express or implied warranties.
  • This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, or durability.
  • Performance parts may require professional installation, tuning, or additional modifications not provided by Better Built Moto LLC.
You accept full responsibility for verifying compatibility and safety.

7. Installation Responsibility
You acknowledge that:
  • You are solely responsible for proper installation.
  • Professional installation is strongly recommended.
  • Incorrect installation can cause catastrophic failure, injury, or death.
Better Built Moto LLC does not provide installation services and is not responsible for installation errors.

8. Returns & Refunds
Our return policy is available on a separate page. By purchasing from us, you agree to those terms.

9. Intellectual Property
All content on this website—including logos, images, product descriptions, and designs—is the property of Better Built Moto LLC and may not be copied or reproduced without written permission.

10. Governing Law & Venue
These Terms & Conditions are governed by the laws of the State of South Carolina.
Any dispute, claim, or legal action must be brought exclusively in a court located in South Carolina.
You agree to this jurisdiction and waive any objection to it.

11. Agreement
By using this website or purchasing any product, you confirm that:

  • You release Better Built Moto LLC from liability.
